General Information
The judicial sale of land for delinquent taxes is allowed under the provisions of Virginia Code Section 58.1-3965. The auction is held at the front door of the historic Circuit Courthouse of Loudoun County, in Leesburg, Virginia.
All properties to be sold are advertised in the Loudoun Times Mirror for four consecutive weeks prior to the sale date.
Terms of Sale

The sale of any parcel is subject to the approval and confirmation of the Circuit Court of Loudoun County.

The Special Commissioner of Sale reserves the right to withdraw from sale any property listed and to reject any bid by declaring “NO SALE” after the last bid received on a parcel.

A Bidder’s Deposit of an amount equal to the total of taxes, penalty and interest owed, or ten percent (10%) of the purchase price, whichever is greater, by cash, cashier’s or certified check, payable to William B. Hanes, General Receiver as to each parcel, is due when the Auctioneer declares the sale. The balance shall be due within thirty (30) days of confirmation by the Circuit Court. Written bids accompanied by a cashier’s or certified check for an amount equal to the total of taxes, penalty and interest owed, or ten percent (10%) of the purchase price, whichever is greater, payable to William B. Hanes, General Receiver, will be received at any time prior to the date of sale and held until auction. Such written bids with deposit shall be sent to Karen J. Stapleton, Special Commissioner of Sale, at the Office of the County Attorney, One Harrison Street, S.E, Fifth Floor, Leesburg, Virginia 20175. If a written bid is approved and confirmed by the Circuit Court, the balance shall be due within thirty (30) days of confirmation.

All successful bidders must certify that they are not the owner of any other property in Loudoun County on which there are delinquent taxes, zoning or other violations.

Properties are offered “as is”, with all faults and without warranties either expressed or implied.

The costs of any title search and all recording costs will be at the expense of the purchaser. Property will be conveyed by Special Warranty Deed.

Announcements made the day of sale take precedence over any prior verbal or written terms of sale.
The Commissioner of Sale represents that information regarding the properties, including acreage, is only from the land records and is not guaranteed for either its completeness or accuracy. Bidders should make their own investigation to determine the suitability of each parcel and to bid accordingly. Any costs incurred by a bidder to inspect or investigate any property are the bidder’s responsibility and are not reimbursable.
The owner of a parcel may redeem it at any time before the date of the sale by paying all taxes, penalties, interest, and costs thereon (including the pro rata costs of publication), and attorney’s fees.
