Marriage License Information

Background

The Clerk of the Circuit Court issues marriage licenses.  The fee is $30.00 cash. Neither checks nor credit/debit cards are accepted. Both parties must appear before the Clerk to obtain a license and must be 18 years of age or older (proof of age required, i.e. valid drivers license, passport or military identification), or if between 16 and 18, a parent must appear with identification. The court will provide a special affidavit for the parents' signature.

There are no residency requirements to obtain a marriage license in Virginia. A couple may go to any Circuit Court in Virginia to obtain this license. Once the license is issued, there is no waiting period and no blood test is required. The marriage license is valid for 60 calendar days and the marriage must take place in Virginia. The marriage license will expire after 60 calendar days therefore you should not obtain your marriage license earlier than 60 days before your marriage ceremony.

Application for a Marriage License

A marriage license is now available as an online application. Please read the following information fully before filing your application.

An application for a marriage license is available online or at the Public Services Division in the Clerk’s Office located on the 2nd floor at 18 East Market Street, Leesburg. For a marriage license, the normal office hours are Monday through Friday, 8:30 a.m. to 3:45 p.m. The bride and the groom must appear to finalize the application and receive the marriage license. Upon presentation of a completed application, photo identification that provides proof of your age, and the $30 filing fee, a marriage license will be issued for you while you wait. You must take an oath before the Clerk or Deputy Clerk before the license is provided to you. The license is valid for 60 calendar days. The minister, priest, or individual performing the marriage ceremony must return the completed license to the Clerk’s Office within five (5) days of the marriage ceremony.  You will be provided with further information by the Clerk’s Office when you receive your licenses.

When you complete the online application you will receive a confirmation number which you need to bring to the Clerks Office to finish your request for a marriage license. If you prefer, you may com to the Clerk’s Office to fill out the application at a public service kiosk. Please remember that both the bride and the groom must appear when the application for a marriage license is filed.

Authority to Perform Marriages in Virginia

For religious marriage ceremonies, most ministers, priests and clergy have been authorized to perform marriages by the Circuit Court. Please confirm with your clergy that they have been duly authorized.

For civil marriages, an individual performing a civil ceremony must be duly authorized as a civil celebrant by the Circuit Court. Please note that Civil Celebrants may only charge up to $50 to perform a civil ceremony. For more information regarding the civil celebrant process, please contact the Clerk’s Office. This request may be handled through the mail by sending a self addressed, stamped envelope to the Clerk's office, or you may call and request by FAX. Out-of-state ministers must be authorized by the Circuit Court to perform marriage ceremonies in Virginia.

Obtaining Copies of a Marriage License

Once you have been legally married, you may need certified copies of your marriage license for social security, insurance or other reasons. To obtain a certified copy of a marriage license, the license must have been issued by the Loudoun County Circuit Court. The certified copy can be obtained either in person or by mail. To obtain a copy in person go to the Public Service Section on the first floor at the Clerk's office. The fee for a certified copy of a marriage license is $2.50 per copy and will be made while you wait.

In order to obtain a copy by mail, the customer must prepare a written request providing the date of the marriage, the name of the groom and maiden name of the bride. A self-addressed, stamped envelope must be enclosed. The fee for a certified copy of a marriage license is $2.50 per copy. If the marriage occurred in the Commonwealth of Virginia, but you are unsure what circuit court issued the marriage license, you can contact the Division of Vital Records in Richmond. The address is Division of Vital Records, Post Office Box 1000 Richmond, VA 23219-1000. The Virginia statutes require a $12.00 fee payable to the State Health Department.
