1. We must have a mandate, writ or commission issued out of any court of record in any state, territory, district, or foreign jurisdiction (VA Code §8.01-411).

2. Provide a certified copy of the original pleading in the underlying case.

3. Give us a request for subpoena duces tecum with the following:

1. Who (Name and full address of person being subpoenaed)
2. What (Records requested in subpoena)
3. Where (Location of where records are to be produced)
4. When (Exact date of when records are to be produced – Allow enough time for clerk’s office in addition to service of subpoena, etc.)
   
   

4. Send $41.00 check (this includes sheriff’s service fee) made payable to Clerk of Circuit Court and mail to Attn: Foreign Subpoena, P. O. Box 550, Leesburg, Virginia 20178. Street address is 18 East Market Street, Leesburg, Virginia 20176.

5. Make an extra copy of everything you are sending and clip together behind original set. (This set is attached to subpoena duces tecum)

Note: To serve via a private process server subtract the $12.00 sheriff’s fee.
