| Overview
The Code of Virginia grants the Clerk of the Circuit Court the authority to Probate a Will, to appoint and qualify an Executor or Administrator for a Decedent’s Estate, to appoint and qualify a Testamentary Trustee, to qualify a Conservator and/or a Guardian for an Incapacitated Adult, to qualify a Guardian for the Person of a Minor and to appoint and qualify a Guardian for the Estate of a Minor. The Clerk of the Circuit Court for Loudoun County has established a Probate Department within the Clerk’s Office to perform these duties.
A person has no legal authority to act or perform any duties as an Executor, Administrator, Testamentary Trustee, Guardian or Conservator until he/she has been appointed by the Judge or the Clerk and until he/she has formally qualified before the Clerk as such.

The purpose of this website is to inform the public of procedural matters involved in the Probate of Wills and the appointment, qualification and duties of an Executor, Administrator, Testamentary Trustee, Conservator or Guardian. This website is not intended to be construed as legal advice about any of these matters or their duties. The Clerk cannot render legal advice. It is hoped, however, that the information herein will prove to be of some use in answering general procedural questions about these matters.

Archives & Current Probate Records
The Clerk of the Circuit Court has Will/Probate/Estate records dating from 1757 when the County of Loudoun was formed. If you are interested in Probate records from 1757 to June 30, 1995, they are located in the Archives Department of the Clerk. More information is available online about the archives.
Probate records from July 1, 1995, to the present are available in the public data computers on the second floor of the Clerk's Office or if you are a subscriber to the Clerk's online records you may access Probate via that system.
