Virginia Clerks begin issuing same-sex marriage licenses 10/6/2014
         
The U.S. Supreme Court announced this morning that the writ for review of the mandate for same-sex marriage in Virginia which was issued by the U.S. District Court, 4th Circuit, has been denied. As of 1:00 p.m. October 6, 2014 our office will begin issuing marriage licenses for same-sex marriages.  All marriage license patrons may experience minor delays in processing marriage licenses as clerks are using manual processes temporarily while new forms are integrated with the computer systems used to issue marriage licenses. We expect the integration process to be completed within the next few business days. At that time we will re-activate the online application.

Marriage License Applications

For your convenience, you may complete your marriage license application prior to arriving at the Loudoun County Clerk’s office by clicking on this link: (*temporarily disabled).  Once you both arrive together with valid state or government photo identifications, it will take approximately 10 to 15 minutes to receive your marriage license. There is a $30 fee that can only be paid by cash or credit card. Please note there is an additional convenience fee for using a credit card.  Marriage licenses are issued Monday through Friday, from 8:00 am to 4:00 pm. You should plan to arrive in our office by 3:30 pm to allow sufficient time for the Clerk’s staff to prepare your marriage license.

Requirements
The Clerk of the Circuit Court issues marriage licenses for ceremonies performed anywhere in Virginia. Both parties must appear before a clerk to obtain a license and must be 18 years of age or older. If any person intending to marry is under the age of 18, a parent or guardian must appear with identification. The minimum age of marriage with consent of a parent or guardian is 16 years of age. The Clerk’s Office will provide a special affidavit for the parents' signature.

There are no residency requirements and couples may purchase their marriage license at any Circuit Court in Virginia. Once the license is issued, there is no waiting period and no blood test is required. The marriage license is valid for 60 calendar days and the marriage must take place in Virginia. The marriage license will expire after 60 calendar days, therefore you should not obtain your marriage license earlier than 60 days before your marriage ceremony.

Authority to Perform Marriages
Please confirm with your clergy/celebrant that they have been duly authorized by a Virginia Circuit Court. The qualified minister, priest, or individual performing the marriage ceremony must return the completed license to the Clerk’s Office within five days of the marriage ceremony.

For religious marriage ceremonies, most ministers, priests and clergy have been authorized to perform marriages by the Circuit Court. Out-of-state ministers must be authorized by the Circuit Court to perform marriage ceremonies in Virginia. This process can take up to three to four weeks to be completed. It is advised that the out-of-state minister contact the Circuit Court where the marriage is to take place for further details. Per §20-27 -
Any person authorized under  §20-25 to celebrate the rites of marriage shall be permitted to charge the parties a fee for the ceremony not to exceed $50 for each ceremony.  Additionally, such person shall be permitted to charge parties travel expenses to and from the marriage site.  If conveyance is by public transportation, reimbursement shall be at the actual cost thereof.  If conveyance is by private transportation, reimbursement shall be at the rate specified in the current general appropriations act of the Commonwealth.  In either event, the actual cost of the ceremony together with travel expenses shall be given to the parties at least three days prior to the marriage ceremony.          
For civil marriages, an individual performing a civil ceremony must be duly authorized as a civil celebrant by the Circuit Court. Civil marriages are not performed by the Clerk's office; however, you may view the list of Loudoun County Civil Celebrants.
