Board Approves Data Center ZOAM

On April 2, 2014, the Loudoun County Board of Supervisors approved the Data Center Zoning Ordinance Amendment (ZOAM). The major changes include defining "Data Center" and adding the use to the following zoning districts as a permitted use:

  • Commercial Light Industry (CLI)
  • Planned Development - General Industry (PD-GI)
  • Planned Development - Industrial Park (PD-IP)
  • Planned Development - Office Park (PD-OP)
  • Planned Development - Research and Development Park (PD-RDP)

In the CLI, PD-OP, PD-RDP, and PD-IP zoning districts, data centers are now subject to performance standards in new Section 5 to 664. This amendment also increases building height and Floor Area Ratio (FAR) in the PD-IP zoning district, and adds a special exception for increased FAR in the PD-GI zoning district. The item prepared for the April 2 meeting, which includes the red-line (now approved) text as Attachment 3, is online. The amendment is effective immediately.

The Board action on the ZOAM came after the Board's Transportation and Land Use Committee (TLUC) recommended approval of the ZOAM by the full Board, subject to the revisions made at the committee's meeting on March 14, 2014.

ZOAG Provides Recommendations to TLUC March 14, 2014

The Zoning Ordinance Action Group (ZOAG) completed its review of the Data Center Zoning Ordinance Amendment and provided recommendations to the Transportation and Land Use Committee at its meeting on Friday, March 14, 2014.

The subcommittee of the Zoning Ordinance Action Group (ZOAG) considering the Data Center Zoning Ordinance Amendment (ZOAM) provided its recommendations to the full ZOAG on Wednesday, February 12, 2014. 

Subcommittee Meeting January 15

The Zoning Ordinance Action Group (ZOAG) subcommittee formed to consider the ZOAM continued its review on Wednesday, January 15, 2014.

The subcommittee held its first meeting on December 16, 2013.

Discussion By Transportation Land Use Committee

The proposed Data Centers Zoning Ordinance Amendment (ZOAM) was discussed at the Board of Supervisors' Transportation/Land Use Committee meeting January 10, 2014.

Update: Data Center ZOAM Issues to be Discussed by ZOAG

At the November 13, 2013, Board of Supervisors public hearing, the Board voted to forward the amendments to the November 15, 2013, Transportation and Land Use Committee meeting for further review. At the Transportation and Land Use Committee meeting, the committee voted to request that the Zoning Ordinance Action Group (ZOAG) and citizens from affected residential communities meet to further discuss the issues identified at the public hearing and provide recommendations back to the committee by March 2014, or sooner, if possible. At a worksession on September 24, 2013, the Loudoun County Planning Commission voted to forward the Data Center ZOAM to the Board of Supervisors with a recommendation of approval, subject to the recommendations deleting proposed Sections 4-306(D) and 4-506(D) dealing with Floor Area Ratio (FAR) averaging and amending proposed Section 5-664(I)(1)(b) dealing with noise testing. The subcommittee formed by the Loudoun County Planning Commission to work on the proposed Data Centers Zoning Ordinance Amendment (ZOAM) met on July 24 and September 11, 2013. The subcommittee forwarded the text revisions back to the full Planning Commission, which held a work session Tuesday, September 24, 2013.

July 16, 2013 Meeting

The proposed amendments to the county's Zoning Ordinance would define and add the new use "data center" to the permitted use lists in certain zoning districts. 

Board Approves Resolution of Intent to Amend

On June 5, 2013, the Loudoun County Board of Supervisors approved a Resolution of Intent to Amend the Revised 1993 Loudoun County Zoning Ordinance, to implement ZOAM 2013 to 0003, Data Center and Miscellaneous Commercial/Industrial Amendments. 

Background

Zoning staff began work on this amendment in February 2013 and worked with the Departments of Economic Development and Planning to identify key issues and draft text. As currently drafted, the text amendments propose to allow data centers as a permitted use in the Commercial Light Industry (CLI), Planned Development-Office Park (PD-OP ), Planned Development-Research and Development Park (PD-RDP), Planned Development-Industrial Park (PD-IP) and Planned Development-General Industry (PD-GI) zoning districts, subject to performance standards.
