1. Where are the ADU Purchase Program properties located?

ADU Purchase Program properties are located throughout Loudoun County, including communities such as South Riding, Stone Ridge, Brambleton, and Lansdowne.

2. Does Loudoun County own the properties offered in the ADU Purchase Program?

Loudoun County does not own the properties being offered to qualified persons through the ADU Purchase Program. The properties are initially owned by a developer/builder or are currently owned by persons who purchased a home through the program and now want to sell the property.

3. I just got approved to participate in the ADU Purchase Program. What happens next?

First, read the Letter of Eligibility/ADU Certificate. It indicates other requirements for the program and provides you with the information you need to access the ADU New Sale Website and the ADU Resale Website.

4. When I receive an offering from a builder and I do not want to purchase one of their homes, will my name be sent to the bottom of the priority list?

No. Your name will remain on the priority list within your priority category mentioned below.

5. I have a large family and/or I want to live in a specific location. Can my name be placed on a special list for communities that meet these criteria?

No. The only criteria for new construction waiting lists are based on where you live and work:
• Priority 1 - Live and Work in Loudoun County
• Priority 2 - Work in Loudoun County
• Priority 3 - Live in Loudoun County
• Priority 4 - Neither Live or Work in Loudoun County

6. I am on the third priority list (lives in Loudoun County/works outside Loudoun County), but if my new job is located in Loudoun County, will that change my priority?

Yes, if that job is your primary form of employment. Once the Program receives a “Change of Information” form and a new Verification of Employment form documenting that your primary job is now located in Loudoun County, your name will be moved from the previously determined Priority List and moved to the newly applicable Priority List.

7. The builder of the home I am purchasing is also offering options. Can I purchase options and how does it affect my sales price and financing?

Yes, you may finance up to a maximum of $10,000 in options. The $10,000 maximum can be added to the ADU base sales price and financed in the mortgage. Any amount over $10,000 may not be financed and must be paid in cash and reflected as such on the ALTA settlement statement.

8. Since I was approved for the ADU Purchase Program, I have moved and have a new address. What do I do?

You must complete a “Change of Information” form and provide evidence of the change (copy of lease, pre-printed bill with new address, or DMV Change). Once the Loudoun County Department of Family Services receives the form, your information will be updated in the system. In some instances, the change may also affect which Priority Group you are in. You will also be moved to the applicable group (again based on the change date, not the original approval date.)

9. How long do you have to live in an ADU?

There is no minimum or maximum amount of time that you have to live in an ADU, but there are restrictions on the sale of the unit. Please read the ADU Covenants for other restrictions.

10. What if the household income increases after an ADU property is purchased? Do I have to move out?

Program staff does not monitor your annual income once you purchase an ADU. If you have purchased an ADU and your income increases above the ADU Maximum Income Limits, you do not have to move out of the home.

11. Do I sell the home back to Loudoun County when I no longer want it?

You must offer the property for sale through the ADU Resale program to an ADU qualified household who has been approved to participate in the program for the first 90 days. The County may elect to purchase the property within the Ordinance required timeframe. Please read the ADU Covenants for further guidance.

12. If I pay off my mortgage before the end of the 15-year resale control period, will the property no longer be an ADU?

No. It will remain an ADU. The program covenants and restrictions run with the property, not the owner or financing. The property remains an ADU, even after the initial 15-year resale control period, for 50 years from the initial sale of the ADU from the builder/developer.

13. Can I use a Realtor to assist me with finding a property with the ADU program?

Yes, you may use a Realtor to assist you with finding a property with the ADU program. The ADU Program does not provide you with a Realtor. It is important that you find a Realtor who is experienced with working with Purchasers. We will need a copy of the Buyer-Realtor Agreement and the Realtor's contract information. With this, the County will authorize the builder or seller to add 1.5% to the ADU sales price to compensate your Realtor.
