Restoring Driving Privileges

  • Original + 2 copies of the petition
  • Original + 2 copies of the DMV transcript and compliance summary
  • Original Order
  • Original civil action cover sheet
  • Original Application for Restricted License
  • Habitual Offender Packet 
  • Third Offender Packet 

Do I petition under habitual or third offender?
You must use the compliance summary from the DMV to determine whether you qualify for habitual, third offender, or both.

A copy of the petition will be served on the Commonwealth's Attorney and the Department of Motor Vehicles (DMV). The Commonwealth may file an objection or answer to the petition within 21 days after it is served.  If you're not eligible for full restoration and are petitioning for a restricted license you must complete the 
Restricted License Application Form, in addition to the Petition and Order. If the Judge grants the application for a restricted license, a separate order for restricted license is required for the DMV and may take up to a week. You will not receive this the same day as the hearing.

Filing Fee
The filing fee is $108 (includes service fee). Must be paid by cash, certified check, money order or personal check (no starter checks will be accepted), made payable to "Clerk of Circuit Court". Please bring or mail your completed paperwork to:

Hearing Dates
Hearing dates in Loudoun County for restoration of driving privileges are set on the Circuit Court Misdemeanor Appeals Day every second Friday of the month at 1:00 pm. When you file your case with the Clerk of the Circuit Court you will be given a hearing date and time that will be noted at the top right-hand corner of the petition. You are required to participate in the Alcohol Safety Action Program (ASAP) you must have your evaluation completed prior to your hearing date.  Information regarding this program can be found here.

You must appear in court on the date that your case is set to be heard.
