Paying Fines

Upon a conviction of a felony or misdemeanor offense, costs, which are assessed pursuant to the Code of Virginia, and/or a fine, will be imposed against the defendant. Costs / fines are to be paid within 30 days of conviction unless a judge grants a deferment date or a payment plan/contract is established.


Payment Contracts

A defendant can petition the Circuit Court Clerk’s office to be placed on a payment contract to pay fines, costs and/or restitution by filing a completed Payment Plan Packet. There are three options for a payment contract:

  • Deferred Payment Contract: You agree to pay the full amount of the fines, costs and/or restitution by the end of the stated terms with no monthly amount required.
  • Installment Payment Contact: You agree to make monthly payments in the agreed upon amount until fines, costs and/or restitution are paid in full.
  • Community Service Contract: Defendant earns credits for performance of community service work to be applied towards fines and costs only.  Hours are credited at the Federal minimum wage rate, currently $7.25 per hour.  Community Service is supervised by the Department of Community Corrections and District 25 Probation and Parole.  An enrollment letter from one of these agencies is required within 30 days of the date of the payment contract or the contract will be null and void.  This option cannot be used to pay off restitution.

A defendant must file a completed petition with the Circuit Court Clerk’s office to request the payment contract. Please complete only those items shaded in blue on the payment contract and the petition. The clerk’s office will review all of the defendant’s accounts to see if specified terms were established by the court before a payment contract can be executed. Please note that some contracts may not be able to be completed on the day you file your petition.  The clerk’s office may need to research older or multiple cases before determining total amounts owed and terms. The clerk’s office will complete the total amounts due and the terms of the contract. You may be required to return to the clerk’s office to execute a contract. You should not sign the contract until all terms have been agreed upon.

A down payment will be required for all payment contracts. Amount of the down payment will be established upon filing the petition and executing a contract.

Upon executing a payment contract, it is your responsibility to ensure that you are making your payments in a timely manner as agreed upon. Please review the payment contract for penalties should you fail to meet your contract obligations.
